Terms of Service

Contract terms for using Brimlo, a professional workspace for autónomos in Spain.

1. Service and intended users

Brimlo provides software for professional/self-employed activity in Spain: invoice and expense records, tax estimates, quarterly checks, integrations and AI-assisted workflows. The service is intended primarily for users acting for business or professional purposes. You must be at least 18 and have legal capacity to contract. If mandatory consumer law nevertheless applies to you, nothing in these Terms limits those mandatory rights.

2. Not professional tax or legal representation

Brimlo organizes data and provides calculations, checks and AI-generated explanations. It is not the Agencia Tributaria, Seguridad Social, a gestoría, law firm or tax advisory practice and does not file returns or represent the user unless a separate service expressly says so. Tax treatment depends on facts and law that can change. The user remains responsible for source documents, classifications, invoice correctness, deadlines, filings and professional advice where needed.

3. Account and user responsibilities

Users must provide accurate information, protect credentials, keep contact details current and promptly review outputs that affect accounting or tax decisions. Users may only upload or import data they are authorized to process. Accounts may not be shared in a way that bypasses plan limits or security controls.

4. Trial, plans and payments

Brimlo currently offers a 30-day trial and may make paid plans available. Before any paid order, the checkout must show the plan, billing period, total price and applicable taxes, renewal/cancellation terms and any material limitations. Paid subscriptions renew only as stated at checkout and can be cancelled for future renewal through the offered account/billing method. Price changes do not retroactively change an already-paid period and material renewal-price changes will be communicated before they apply.

5. Electronic contracting information

The contracting steps are: choose a plan, review the displayed price/period and these Terms, correct any input errors, provide the requested payment information and activate the order using the clearly labelled payment action. Contract records may be stored electronically for legal, billing and support purposes. The user can save/reproduce these Terms and receives an electronic confirmation of the accepted order. Brimlo supports the languages offered in the relevant checkout; where Spanish consumer rules require it, pre-contract information is also available in Spanish.

6. Withdrawal where consumer law applies

Brimlo is designed for professional use by autónomos, so consumer withdrawal rules will often not apply. If the user qualifies as a consumer under mandatory Spanish/EU law, the statutory distance-contract withdrawal right applies unless a lawful exception applies. For services, merely starting performance does not by itself remove that right; loss after full performance requires the conditions laid down by law. Any request to start a paid service during a withdrawal period and any acknowledgement required by law must be collected expressly at checkout. A consumer can exercise an applicable withdrawal right by an unequivocal notice to the contact in the Legal Notice; no special wording is required.

7. Acceptable use

Users must not use Brimlo unlawfully, infringe third-party rights, upload malware, probe or bypass access controls, scrape or overload the service, falsify documents or transactions, or use AI/integrations to facilitate fraud. We may restrict or suspend access where reasonably necessary to protect users, the service or comply with law.

8. Integrations

Third-party integrations are optional and may be governed by the third party's own terms. The user authorizes Brimlo to access and process only the connected data needed for the selected integration. Third-party API availability can change independently of Brimlo.

9. Intellectual property and user data

Brimlo and its software, design, brand and original content are protected by intellectual-property law. Users retain rights in their own records and documents and grant Brimlo only the rights needed to host, process, back up and transmit them to provide the service and user-requested integrations. Feedback may be used to improve Brimlo without disclosing confidential user content.

10. Privacy and processor terms

Brimlo's processing of account/user data is described in the Privacy Policy. Where Brimlo processes personal data contained in a professional user's customer/supplier records on that user's behalf, the Brimlo DPA is incorporated into these Terms and governs that processing.

11. Availability and changes

We aim to keep Brimlo available but do not promise uninterrupted operation. Maintenance, security incidents, third-party outages and legal changes can affect features. Material changes that substantially reduce a paid service will be handled in accordance with the contract and mandatory law.

12. Liability

Nothing excludes liability that cannot lawfully be excluded. Subject to mandatory law, Brimlo is not responsible for losses caused by inaccurate source data supplied by the user, unreviewed AI output, third-party platform failures or the user's failure to meet legal/tax deadlines. Any contractual limitation for professional users will be interpreted reasonably and does not apply to fraud, wilful misconduct or other liability that Spanish law makes non-excludable.

13. Suspension, cancellation and deletion

Users may stop using Brimlo and may request account deletion through the available account controls. Cancellation of a paid subscription prevents future renewals but does not automatically erase records that the user has chosen to retain until account deletion. We may terminate or suspend for serious breach, security risk, non-payment or legal requirement, with notice where reasonably possible.

14. Governing law and disputes

These Terms are governed by Spanish law. Mandatory jurisdiction and consumer protections are preserved. For users acting in a business/professional capacity, disputes are submitted to the competent Spanish courts determined by applicable procedural rules unless the parties validly agree otherwise. Before litigation, users are encouraged to contact us so we can try to resolve the issue.

15. Changes to these Terms

The current version is published here. Material changes to an active paid contract will be notified in advance where required. Continued use after the effective date only constitutes acceptance to the extent permitted by applicable law.
